This website (my-machines.net) is operated by My-Machines. Throughout the site, the terms “we”, “us” and “our” refer to My-Machines. We offer this website, including all information, tools, open-source documentation, digital files, and hardware products available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.

1. Online Store Terms

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws regarding proprietary designs, if applicable). A breach or violation of any of the Terms will result in an immediate termination of your Services.

2. General Conditions

We reserve the right to refuse service to anyone for any reason at any time. You understand that your content (not including credit card information), may be transferred unencrypted and involve transmissions over various networks. Credit card information is always encrypted during transfer over networks (processed via secure third-party gateways like Stripe or PayPal). You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.

3: Accuracy and Completeness of Technical Information

We are an open-source hardware and DIY (Do-It-Yourself) project platform. While we strive to provide highly accurate documentation, Bill of Materials (BOM), assembly guides, firmware configurations, and 3D models (STL/STEP files), we are not responsible if information made available on this site is not fully accurate, complete, or current. The material on this site is provided for general information and educational/maker purposes only. Any reliance on the engineering files or guides provided by My Machines is at your own risk. We reserve the right to modify the contents of this site and our technical repositories at any time, but we have no obligation to update any information on our site.

4. Modifications to the Service and Prices

We secure the information you provide on computer servers in a controlled, secure environment, protected from unauthorized access, use, or disclosure. We keep reasonable administrative, technical, and physical safeguards to protect against unauthorized access, use, modification, and personal data disclosure in our control and custody. However, no data transmission over the Internet or wireless network can be guaranteed to be completely infallible.

5. Products, Hardware Kits, and Digital Downloads

Certain products or Services may be available exclusively online through the website. These products or Services may have limited quantities and are subject to return or exchange only according to our Return & Refunds Policy.

• DIY Hardware & Kits: We make every effort to display as accurately as possible the colors, specifications, and dimensions of our physical products. However, raw mechanical parts (extrusions, plates, fasteners) may vary slightly in finish.
• Digital Products (STL, STEP, Firmware): Digital downloads are delivered instantly upon successful payment or registration. Due to the nature of digital goods, all sales of downloadable products are final once the download link has been accessed or generated.

We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region, or jurisdiction.

6. Accuracy of Billing and Account Information

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the email and/or billing address/phone number provided at the time the order was made.

You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

7. Third-Party Links & Community Repositories     

 Certain content, products, and Services available via our Service may include materials from third-parties (such as GitHub repositories, open-source firmware like Klipper/Marlin, or community forums). Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites.

8.  Disclaimer of Warranties; Limitation of Liability (CRITICAL DIY CLAUSE)   

We do not guarantee, represent, or warrant that your use of our service will be uninterrupted, timely, secure, or error-free.

YOU EXPLICITLY AGREE THAT YOUR USE OF, OR INABILITY TO USE, THE PRODUCTS AND SERVICES PROVIDED BY MY MACHINES IS AT YOUR SOLE RISK. All products and hardware kits delivered to you through the service are provided 'as is' and 'as available' for your assembly. Because our products are DIY (Do-It-Yourself) machines, My Machines is not liable for any physical injury, property damage, electrical fires, or mechanical failure caused by incorrect assembly, improper wiring, lack of calibration, or misuse of the machines by the end-user. It is the customer's sole responsibility to ensure safe workshop practices, correct mains voltage wiring, and proper machine operation.

In no case shall My-Machines, our directors, officers, employees, or partners be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service.

9. Governing Law

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Portugal and the European Union. Any disputes arising from these terms shall be settled in the competent courts of Portugal.

10.  Prohibited Uses and Illegal Fabrication Disclaimer

Our products, hardware kits, mechanical components, firmware, and documentation are intended strictly for lawful engineering, creative, prototyping, educational, and legitimate commercial purposes.

You are strictly prohibited from using any hardware, components, documentation, or designs provided by My Machines to manufacture, modify, or assemble:

• Firearms and Weapons: Any form of lethal weaponry, firearm components, ammunition, or unregulated firearms (commonly referred to as "ghost guns").
• Restricted Items: Illegal blades, tactical weapons, or any item designed to inflict harm that violates the local, national, or international laws of your jurisdiction.
• Counterfeit Goods: Any parts intended to violate intellectual property or trademark laws.

My Machines holds a strict zero-tolerance policy regarding the use of our machinery or ecosystem for illegal manufacturing. We do not support, condone, or facilitate the creation of weapons. My Machines explicitly disclaims any and all liability for any legal infractions, criminal charges, property damage, or personal injuries resulting from the user's decision to utilize our products or documentation for the illegal fabrication of weapons or restricted goods. We reserve the right to terminate service, delete user accounts, and fully cooperate with law enforcement authorities should any violation of this section come to our attention. 

11. International Shipping, Customs, and Import Duties

If you order physical products or hardware kits from outside the European Union, your order may be subject to import duties, taxes, and customs clearance fees levied by your country. All such additional charges are the sole responsibility of the customer. My Machines has no control over these fees and cannot predict their amount. If you refuse a shipment due to customs fees, you will be responsible for the original shipping charges, any import fees incurred, and the cost of returning the package to us.

12. Intellectual Property and Open-Source Licensing

While certain digital assets, 3D models (STL/STEP), and firmware provided on this site are released under open-source licenses (allowing for personal modifications and community collaboration), the "My Machines" brand name, logo, website design, text copy, and commercial graphics are the exclusive intellectual property of My-Machines. You may not use our trademarks or brand identity for any commercial purpose or to imply an official endorsement or affiliation without our express written consent.

We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes.
